he Promised Lands Section of the Florida Chapter of
American Planning Association is presenting an informative and interactive
seminar on Growth Management Legislation. Dr. David Depew, of
Morris-Depew Associates, Inc. and Neale Montgomery, Esq. of
Pavese Law Firm will be leading the discussion.
The session is intended to provide a detailed analysis
related to the implementation of the new definitions, procedures,
requirements found in the 2011 growth management legislation after a year
of experience. Statutory changes in 2011 and 2012 made substantial changes
to comprehensive planning with impacts at the state, regional and local
level.
Specifics regarding the changes in Agency scope of
review, planning horizons, supporting data and analysis, citizen standing,
dispute resolution, statutory requirements related to concurrency and
proportionate share calculations, and urban sprawl review will be
discussed. The thrust of the session is to provide local planners with statewide
knowledge related to the new interpretations, legal decisions, and local
responses to the new legislative mandates. Emphasis will be on providing a
framework for understanding how the new State requirements for local
control of the comprehensive planning process have been interpreted. The
inclusion of legal expertise as part of the presentation is intended to
establish a legal/procedural context for understanding the application of
the new legislation and the judicial evolution since the adoption of the
Act.
The session will end with
the panelists answering questions from the seminar attendees.
